What Constitutes “Malpractice or Negligence” by the Design Professional?

Unless there is a specific modification in the contract, a Design Professional is required to perform in accordance with the “Standard of Care”. The Design Professional is required to perform their services consistent with professional skill and care ordinarily provided by Design Professionals practicing in the same or similar locality under the same or similar circumstances.

Most claims made against the Design Professional have to be tied to negligence/malpractice, but if the Design Professional states in their contract that they will perform a specific function and fails to dos so, a claim can be based upon breach of contract.
