Professional Liability for Architects and Engineers
– defining Professional Services
Each insurance company has a different definition of what is considered a Professional Service under the policy. It is essential that your firm is aware of what services your firm will be covered for in the event of a claim. Below are some of the definitions in those policies.
Example #1
Services the Insured performs for others in the practice of an architect, engineer, land surveyor, landscape architect, construction manager, space planner, land planner, interior designer, scientist, technical consultant, expert witness or as defined by endorsement to the policy.
Example #2
“Professional Services” means services the Insured performs for others in the practice of an architect, engineer, land surveyor, landscape architect, construction manager, planner, interior designer, scientist, technical consultant, forensic engineer, expert witness or as defined by endorsement to the Policy.
Example #3
“Professional Services” means those services provided by the Insured or by any person for whom the Insured is legally responsible acting in the capacity of an architect, engineer, landscape architect, land surveyor, interior designer, construction manager, technical consultant, environmental consultant, including Sustainability of any such service or as specifically endorsed hereon.
Example #4
Professional Services means only services in any of the following capacities:
- Architect.
- Engineer.
- Land surveyor.
- Landscape architect.
- Construction manager.
- Scientist.
- Technical consultant.
It is important that your firm understands what the Professional Services are in your Professional Liability policy. As shown in the examples above, one includes forensic engineering and the others don’t. Another example includes scientists and the others don’t.
